Subjects eligible for trademark registration application

Where any natural person, legal person or other organization, in the course of his or its production or business operations, intends to acquire the exclusive right to use a trademark for his or its goods or service, an application should be filed with the Trademark Office for registration of the trademark. Two things should be noted: (1) Two or more natural persons, legal persons or other organizations may jointly apply to the Trademark Office for the registration of the same trademark, and enjoy and exercise the right to exclusive use of that trademark jointly. (2) Where a foreigner or a foreign enterprise applies for trademark registration or deals with other trademark matters in China, it shall entrust an organization certified by the Chinese Government as having the qualification for trademark agency to act on its behalf.
