iPad“商標(biāo)侵權(quán)”案

一個 iPad 商標(biāo)，引發(fā)了一場知識產(chǎn)權(quán)的血戰(zhàn)，也引發(fā)了網(wǎng)友的圍觀。蘋果公司在與唯冠科技(深圳)有限公司的商標(biāo)侵權(quán)案中一審判決敗訴，唯冠申請禁售令，蘋果公司iPad在中國各地的專賣店遭遇下架。

Trademark infringement就是指“商標(biāo)侵權(quán)”，是指行為人未經(jīng)商標(biāo)權(quán)人許可，在相同或類似商品上使用與其 trademark registration(注冊商標(biāo))相同或近似的商標(biāo)，或者干涉、妨礙商標(biāo)權(quán)人使用其注冊商標(biāo)，損害商標(biāo)權(quán)人legitimate interest(合法權(quán)益)的其他行為。行為人銷售明知或應(yīng)知是counterfeit registered trademark(假冒注冊商標(biāo))的商品, right to exclusive use of trademark(商標(biāo)專用權(quán))被侵權(quán)的natural person(自然人)或者legal entity(法人)在civil affairs(民事)上有權(quán)要求侵權(quán)人cessation of infringement(停止侵害)、eliminate ill effects(消除影響)、redress damage(賠償損失)。
