Refund for failure to raise scores
( 2003-08-18 14:30) (China Daily)

A company which failed to help a student improve his grades as promised in a contract has been forced to refund his tuition in full, reports Beijing Evening News.

Tang paid 5,500 yuan (US$660) to a tutoring centre in April. In the contract, the centre guaranteed that the boy would either advance 10 places in his class' rankings or he would earn 10 points more than the average score on his final examination.

"If the goal is not realized, the centre will refund the payment," the contract said. But when Tang asked the centre to return the money after her child's scores fell instead of rising, the centre said it could only refund 10 per cent of the original payment.

Tang turned to the Haidian District bureau for industry and commerce for help, and the company was ordered to make a full refund.
